Article 2 - Management Rights
A. The Board and the Association agree to maintain the academic
character of the University of Maine System (hereafter University)
as an institution of higher education.
B. The rights, functions, powers, duties and responsibilities of
the Board and its officers and agents, under applicable state law
and the Bylaws of the Board, including the Board's right to alter
or waive existing Bylaws or policies in accordance with the procedures
specified in the Bylaws shall remain vested in the Board and in
said officers and agents except as modified by this Agreement.
C. Nothing contained in this Agreement shall be construed to diminish
the rights granted under the Bylaws of the Board to the entities
and bodies within the internal structure of the University so long
as such rights are not in conflict with a stated term of this Agreement.
D. Nothing contained in this Agreement shall be construed to prevent
the Board and its officers and agents from meeting with any individual
or organization to hear views on any matters. The Board or its officers
and agents shall at all times be cognizant of the status of the
Association as the sole and exclusive bargaining agent under the
University of Maine System Labor Relations Act for unit members.
